NOTE 26: ADD: Where an interim injunction might affect the exercise of the right to freedom of expression, the position is slightly different. In such cases, it will normally be necessary to show more than a “real prospect” of success, but the court may dispense with this higher standard where particular circumstances make this necessary: Cream Holdings Ltd v Banerjee [2004] UKHL 44, at [20]-[23]; applied in Boerhinger Ingelheim Ltd v Vetplus Ltd [2007] EWCA Civ 583.
