ADD TO FOOTNOTE 50: For example, a person who has yet to be appointed an administrator generally has no right to possession of the deceased's assets unless perhaps that would be necessary to safeguard the estate.   But an executor would have an immediate right to possession once the testator died: Caudle v L D Law [2008] EWHC 374 (QB), [2008] 1 W.L.R. 1540.
