2. Proprietary claim

 

32-20 Legatees, devisees and next-of-kin may rely upon their limited equitable title to trace the assets of the deceased, notwithstanding an assent or conveyance by the personal representative.  [A.E.A. 1925, ss.36(9), 38; above, para. 31-14.]  They may enforce proprietary claims against recipients other than bona fide purchasers without notice.  [Re Diplock [1948] Ch. 465.]  In this respect their claims are similar to those of a beneficiary under a trust.  [Above, para. 28-35 et seq.]
